1. Agreement
These Terms of Use (the “Terms”) govern the use of the FocusLapse iPhone application (the “App”) provided by cocon合同会社 (“we,” “us,” or the “Company”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
2. The service
The App helps you record study or work sessions as time-lapse videos and manage focus time, ratings, notes, and digest videos on your device. The App does not guarantee a particular learning result, grade, work result, or habit.
3. Device requirements and permissions
You need a compatible iPhone, a supported version of iOS, and sufficient storage. Time-lapse recording requires Camera permission, and exporting a video may require access to Photos. Some features may become unavailable because of device limitations or changes to iOS.
4. Your responsibility when recording and sharing
Before recording, you are responsible for checking applicable law, the rules of the location, school, or workplace, and the rights of other people.
- Obtain consent from a person or their guardian where appropriate if they may appear in a recording.
- Avoid capturing confidential information, personal information, copyrighted material, or anything else that should not be disclosed.
- Before sharing to social media or another service, review the video and the destination’s privacy settings.
5. Storage and backups
Recorded videos, digest videos, focus records, ratings, and notes are stored on your device. They may be lost because of device failure, insufficient storage, operating-system changes, or deletion of the App. Export videos you want to keep to Photos and make any backups you consider necessary.
6. Prohibited conduct
You must not:
- use the App in violation of law, public policy, or another person’s rights;
- record or share content that infringes privacy, portrait rights, copyright, or other rights;
- misuse, analyze, modify, redistribute, or interfere with the App or its operation;
- impersonate the Company or another person; or
- engage in other conduct we reasonably determine to be inappropriate.
7. Third-party services
If you use the App Store, Photos, social media, or another external service through the App or official website, that service’s own terms and privacy policy apply. We do not guarantee the continued availability or content of a third-party service.
8. Intellectual property
Intellectual-property rights in the App, official website, logo, software, design, and text belong to the Company or their lawful owners. Rights in videos you create with the App belong to you or to the lawful owners of the material shown in those videos.
9. Changes, suspension, and discontinuation
We may change, suspend, or discontinue all or part of the App for maintenance, failure recovery, security, changes in law, iOS or App Store policy, or another reasonable reason. We will provide notice of a material change on the website, in the App, or through another appropriate method where reasonably possible.
10. Disclaimer and limitation of liability
The App is provided “as is.” We do not guarantee completeness, accuracy, fitness for a particular purpose, uninterrupted availability, or that errors or data loss will never occur. To the extent permitted by law, we are not liable for indirect, special, or consequential loss, lost profit, or data loss resulting from use or inability to use the App.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable consumer-protection or other mandatory law.
11. Changes to these Terms
We may update these Terms as permitted by law. We will provide the revised terms and their effective date on the official website, in the App, or through another appropriate method. Unless applicable law requires a different procedure, continued use after the effective date means that you accept the revised Terms.
12. Governing law
These Terms are governed by and interpreted under the laws of Japan. These Terms do not limit rights that mandatory law gives you in the country or region where you live.
13. Language
This English translation is provided for convenience. If the English and Japanese versions differ, the Japanese version prevails unless applicable law requires otherwise.
